Terms & Con­ditions (AGB)

These Terms & Conditions apply to all locations and services of CF Wädenswil GmbH (hereinafter "WE.FIT"), Zugerstrasse 162, 8820 Wädenswil, including Wädenswil and Meilen.

Membership

1.1 Membership is established by signing up for a subscription — online, in the app, or on-site. By signing up, the member accepts these Terms & Conditions.

1.2 Membership is personal and non-transferable.

1.3 Members must be of legal age. Minors require the written consent of a parent or legal guardian, who assumes full responsibility.

1.4 By signing up, the member confirms that they are in suitable physical and mental condition for sports activities. In the event of changes to their health, training must be adapted or paused on the member's own responsibility.

1.5 WE.FIT may exclude members from training if a risk of injury cannot be ruled out.

Subscription & Pricing

2.1 Current subscription options and prices are available at www.we.fit/en/pricing and form part of these Terms & Conditions.

2.2 Payment is made by online payment (TWINT, credit card, PostFinance), bank transfer, or on-site. Monthly subscriptions are due on the 1st of each month. Semi-annual and annual subscriptions are payable in advance.

2.3 If payment is not received, the membership will be suspended. Access to training and facilities is revoked. The payment obligation remains in force.

2.4 The current Terms & Conditions and prices at the time of renewal apply to new or extended contract periods.

Contract Duration & Cancellation

3.1 The contract duration depends on the chosen subscription.

3.2 Either party may cancel the contract with 30 days' notice to the end of the month. Without cancellation, the contract automatically renews for one additional month.

3.3 Cancellation must be made in writing — by email to info@we.fit, via the app, or through the member portal.

3.4 Refunds of subscription fees already paid are not available.

Suspension

4.1 Holiday absences, travel, and other personal circumstances do not entitle the member to a suspension of membership or a refund.

4.2 In the event of a medically certified injury or illness (written certificate required), the subscription may be suspended once per calendar year for a minimum of 1 month and a maximum of 2 months. The suspension period is added free of charge to the end of the regular contract term. No refund is made.

4.3 During a suspension, there is no access to training or facilities. Cancellation during a suspension is not possible.

Conduct & Exclusion

5.1 Coach instructions must be followed. Anyone who disregards instructions or endangers other members may be excluded immediately.

5.2 WE.FIT may terminate membership with immediate effect in the event of:

  • a)Violations of the house rules despite a formal warning
  • b)Intentional or grossly negligent damage to equipment or facilities
  • c)Consumption, sale, or promotion of prohibited substances on the premises
  • d)Behaviour that harms the operations, community, or reputation of WE.FIT

5.3 In the event of immediate termination, there is no right to a refund. Material damage caused by the member will be invoiced.

Services & Hours

6.1 WE.FIT offers CrossFit, HYROX, Yoga, and other classes. The available offering depends on the chosen subscription.

6.2 Additional services (personal training, workshops, events) are charged separately.

6.3 Services and opening hours may be adjusted at any time. Operational closures (public holidays, maintenance, force majeure) do not give rise to any right to reimbursement or extension.

Health & Liability

7.1 Training takes place at the member's own risk. By participating, the member confirms that there are no health restrictions that would prevent participation.

7.2 Completing the health questionnaire before the first training session is mandatory. Any changes to health status must be reported to coaches without delay.

7.3 WE.FIT is not liable for health damage arising in connection with training, to the extent not required by mandatory law.

7.4 Taking out personal accident and liability insurance is the member's responsibility and is recommended.

7.5 No liability is assumed for loss or theft of personal belongings on WE.FIT premises.

Important: Always inform your coach before class about any injuries, limitations, or health concerns. Your safety is our highest priority.

Privacy & Media

8.1 WE.FIT stores and processes the member's personal data to the extent necessary for managing the membership. The provisions of the Swiss Data Protection Act (DSG) apply.

8.2 Photos and videos may be taken on WE.FIT premises for social media and marketing purposes. Anyone who does not wish to be photographed should inform the coach before training.

8.3 Anonymised usage data may be collected through use of the WE.FIT app and website. Details are described in the Privacy Policy.

Digital Consent

9.1 Acceptance of these Terms & Conditions may be given digitally — via app, website, or email confirmation. Digital consent is equivalent to a handwritten signature.

9.2 WE.FIT records the time and method of consent.

9.3 In the event of material changes to these Terms & Conditions, existing members will be informed and asked for renewed consent. Continued use of services after the new Terms come into force constitutes acceptance.

10

Final Provisions

10.1 Amendments to these Terms & Conditions are reserved and will be communicated to members in an appropriate manner.

10.2 Verbal side agreements do not form part of the contract.

10.3 Should individual provisions be invalid, the remaining provisions are unaffected.

10.4 Swiss law applies. Jurisdiction (Gerichtsstand) is Horgen ZH.
